摘要：村民自治從開始實施到現在不過十多年時間，是正在實踐中的一項年輕的事業，在其實施過程中肯定會遇到諸多的困難和問題。我們知道，從一項法律制度的形成到實踐該法律制度并使其成熟，必須經過長期、艱辛的努力。村民自治也不例外，從十幾年前全國人大將村民自治寫入憲法、制定《中華人民共和國村民委員會組織法》以后，全國各地農村先后實施了村民自治，其實施過程暴露了許多思想上、觀念上以及法律上的問題。從現有的全國性規范村民自治的法律來看，除了《中華人民共和國村民委員會組織法》以外，沒有其他有關村民自治的實體法和程序法。地方法規中，本市已經有了《上海市村民委員會選舉辦法》、《上海市實施〈中華人民共和國村民委員會組織法〉辦法》兩部法規，這是總結了前階段的實踐制定的法規，使本市村民自治有了比較可靠的法律保障。但是，筆者以一個實踐者的角度來考察本市的村民自治，發現了一些問題，如由村民委員會的法律地位聯系到村民在自治管理中處于相對方而涉及到的司法救濟問題、“村民”的界定問題、《村組法》實施的某些操作程序問題、基層政府指導村民自治的程序問題等，都必須以法律法規的形式加以明確。筆者通過從實踐中出現的法律問題的分析和考察，提出了自己的觀點和建議，如通過立法授予村民委員會行使行政職權從而擁有獨立的“行政主體”地位、科學地界定“村民”的范圍等，即要把村民自治這項事業做好，必須完善現有的一些實體法律，并且要重視程序性法規的立法工作，以不斷推進村民自治法律制度。

Abstract:Asanewlyappearedcausewithanexecutionperiodofnomorethantenyears,sureenoughVillagerAutonomyhasencounteredvariesdifficultiesandproblems.Asweallknow,fromitsestablishmenttomaturepractice,alegalinstitutionshouldgothroughasustainedandhardlystruggle.TheVillagerAutonomyhasnoexception.SincethePeople’sCongressofStateincludedVillagerAutonomyintoourconstitution,anddevelopedthe“LawofVillagerCouncilStructureofP.R.C.”tenyearsandmoreago,allthecountrystatesofChinarealizedVillagerAutonomyoneafteranotherinwhoseprocess,manyidealisticandjuralproblemhavebeenexposed.HavinglookedupourcurrentnationalnormativelawsofVillagerAutonomy,wefoundthatwehavenoentitylawsandprocedurelawrelatedtoVillagerAutonomyexceptthe“LawofVillagerCouncilStructureofP.R.C.”.Andlocalstatute,Shanghaihashad“VoteRuleofVillagerCouncilofShanghai”and“TheWaytoCarryOutthe‘LawofVillagerCouncilStructureofP.R.C.’ofShanghai”whichbothsummarizetheformerexperienceandprovidealegalguaranteetoVillagerAutonomy.However,havingreviewedtheVillagerAutonomyofShanghaiintheangleofpractitioner,theauthorfoundsomeproblemswhichshouldbeclarifiedjurally.Forexample,problemaboutlegalcapacityofvillagercouncilrelatedtojudicialalmsgivingwhenvillagersfacethesuperviseofVillagerAutonomy,definitionofVillager,operationalproceduretorealizethe“LawofVillagerCouncilStructureofP.R.C.”,programtoguidetheVillagerAutonomyetc.Theauthorindicatedhisideaandproposalbyanalyzeandreviewthepresentlegalproblem:theVillagerCouncilshouldbeawardedadministrativeauthorityvialawmakingsothatitcouldbeheldstatusofprincipalpartofadministration;tofixthedefinitionofVillagerscientificallyetc..InordertoenhancelegalinstitutionofVillagerAutonomyandachievefromthecauseofVillagerAutonomy,itisnecessarythatweshouldattachgreatimportancetotheestablishmentofprocedurelawsandimprovecurrententitylaws.
